Using this website.

These terms cover this website. Using the agense platform is governed by a separate written agreement between us and your organisation — nothing on this site creates one, and nothing here varies one you have already signed.

Who we are

Experience Technical Consultants Limited (company number 11064051), registered at Fulford House, Newbold Terrace, Leamington Spa, Warwickshire, CV32 4EA, trading as agense. These terms govern your use of agense.io and its subdomains, excluding the product application. By using the site you accept them; if you do not, please do not use it.

What these terms do not cover

Use of the agense platform is governed by a separate written agreement — an order form and service terms, together with a data processing agreement. Where this page and a signed agreement conflict, the signed agreement wins. Nothing on this website varies it, and no page here is an offer capable of acceptance.

Pricing shown here is indicative

The prices and the stack configurator are published so you can understand how the product is packaged and roughly what it costs. They are an invitation to talk.

  • Configuring a stack does not create a contract, reserve anything, or commit either of us. No payment is taken on this website and no payment details are collected.
  • Prices are quoted in pounds sterling and exclude VAT and any other applicable taxes. They may change; the price that applies to you is the one on your order form.
  • Modules shown as in build are exactly that. Availability dates are not promises, and you should not buy on the assumption that an unbuilt module will arrive by a particular date.

Demos, pilots and trials

Booking a demo or asking about a pilot creates no obligation on either side. A pilot begins only when both parties sign the agreement covering it, which sets out its scope, duration, price, and what happens to your data at the end.

Acceptable use

You agree not to:

  • use the site unlawfully, or in a way that damages it or impairs anyone else’s use;
  • attempt to gain unauthorised access to the site, the platform, or any server, network or account connected to them;
  • scrape or systematically extract content, except as a well-behaved search engine crawler respecting our robots.txt;
  • introduce malicious code, or overwhelm the site with automated requests.

Security researchers acting in good faith are welcome. Please report findings to security@agense.io before disclosing publicly, and give us a reasonable period to respond. We will not pursue you for good-faith research that respects this.

Our intellectual property

The content of this site — text, design, diagrams, the agense name, wordmark and logo — is owned by or licensed to us. You may read it and link to it. You may not copy, adapt or republish it commercially without our written permission. Nothing here grants you any right in the platform or its software.

Third-party names, marks and logos

Where this site names or shows the mark of another product or company — for example to describe an integration — those names and marks belong to their owners and are used for identification only. Their appearance does not imply that agense is affiliated with, endorsed by, sponsored by or certified by them, or that any particular integration is available to you.

If you own a mark used here and want it removed, contact hello@agense.io and we will do so.

Accuracy and availability

We take care over what we publish, but this site is general information. Product descriptions, roadmaps and performance figures are given in good faith and may change.

Figures we publish as measured results carry a statement of the artefact they were measured from and the date a person signed them off. Treat anything without such a statement as illustrative. We would rather label something illustrative than let it be read as a result.

We do not promise the site will be uninterrupted or error-free, and we may change, suspend or withdraw any part of it without notice.

Where we link to a third-party site we do so for convenience. We do not control those sites and are not responsible for their content or how they handle your data.

Liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded.

Subject to that, and in relation to your use of this website only: we exclude implied warranties to the fullest extent the law allows, and we are not liable for loss of profit, loss of business, business interruption or loss of anticipated savings arising from your use of or inability to use this site. Liability for the platform is dealt with in the subscription agreement, not here.

Privacy

How we handle personal data is set out in our privacy policy, which forms part of these terms.

Changes

We may update these terms. The date above reflects the current version, and continuing to use the site after a change means you accept it.

Governing law

These terms, and any dispute arising out of them, are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
